ʔəms nəm – TLA'AMIN NATION PRIVACY POLICY

Tla'amin Nation (“we”, “our” or “us”) respects your privacy and is committed to protecting it. This Privacy Policy applies to your access to the ʔəms nəm application and any related mobile applications, including any content, functionality or services offered through the application or related online offerings (collectively, the “App”) whether as a guest or a registered user.  

This Privacy Policy is legally binding. By using our App or agreeing to the Terms of Use for the App, you expressly accept and agree to be bound by this Privacy Policy. If you do not agree to this Privacy Policy, you must not access or use our App or Services.

This Privacy Policy sets out how we collect information from you when you visit our App, either automatically, or through certain voluntary actions you may take while visiting our App, including but not limited to, accessing or downloading any content or resources available on our App or engaging or interacting with the App (collectively, “Services”).

This Privacy Policy also sets out how we use and disclosure your information and your rights with respect to any Personal Information that we collect. This Privacy Policy is intended to establish responsible and transparent practices for the management of Personal Information and to satisfy the relevant and applicable legal requirements.

This Privacy Policy applies to information we collect:

  • On or through the App;
  • In email, text and other electronic messages between you and the App;
  • When you interact with us on third party applications or websites if those applications or websites include links to this Privacy Policy.

This Privacy Policy does not apply to information collected by:

  • Us offline or through any other means, including on any other application or website operated by us, or any third party including our partners, affiliates and subsidiaries;
  • Any third party involved in the creation, hosting, development or infrastructure support for the App, including for greater certainty CheckingIn Software Ltd. (“CheckingIn”), as those parties will have their own privacy policy which will apply to any such collection.  CheckingIn’s Privacy Policy can be found BELOW.

Please note: we may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by in-App message, email (sent to the e-mail address specified in your account) or by means of a notice in the App prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices

INFORMATION WE COLLECT

We collect certain types of information from you when you visit our App. By accepting this Privacy Policy, you are expressly consenting to (i) our collection of information as described below; (ii) our use of the information collected; (iii) the processing of this information; and (iv) our sharing of data with third-party processors as needed to run our organization.


Here are some examples of the data we collect. Please note that this may not be a complete list:

Personal Information: Personal identifying information such as your name, billing and/or shipping address, telephone numbers, email addresses, and other demographic information, such as your age and gender.

User Account Information: In order to access certain Services, we may require you to create a user account and provide your name and/or email address and create a unique password. For your security, we do not have access or knowledge of your password and it is your sole responsibility to keep the password confidential and not share your account details with any other people, including us.

Sensitive Information

We will not request sensitive information from you at any time. Please do not submit any sensitive data to us, including your social insurance or security number, health data, genetic data, or information related to your ethnic origin, religious beliefs, or criminal history. If you do send us this information, then by doing so you are consenting to our use, storage, and processing of this information in accordance with this Policy.

What Personal Information is Not

This policy does not cover non-personal information, which is information that does not identify you. However, in the event that we link any non-personal information to an identifiable individual, then that information will become personal information and become subject to this policy. For greater certainty, personal information that is aggregated and/or anonymized or that cannot be associated with an identifiable individual is not personal information.

HOW WE COLLECT YOUR INFORMATION

Information You Voluntarily Provide

We collect information you voluntarily and manually provide when you use our App, such as when you access Services or certain content on our App, sign up for our email list or newsletter, submit a form, send us questions, or interact with us through this App such as when you provide comments or feedback. Some of the information you manually provide may be personal information, such as your name or email address.

Third-Party Use of Cookies and Other Tracking Technologies 
Some content or applications, are served by third-parties, including advertisers, ad networks and/or servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

App Analytics

From time to time, we may use third party analytic tools operated by third-party companies. These analytic tools may also use cookies or other tracking technologies to analyze visitors’ use of our App to determine the popularity of the content, and better understand online activity. We do not transfer personal information to these third party vendors. However, in order to access our App, you are consenting to the collection and use of your information by these third party analytic companies. We recommend you  review their respective privacy policies and contact them directly with any questions or requests to delete your information.

Email Policies

We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as expressly set out in this Privacy Policy. In compliance with Canada’s anti-spam legislation all e-mails sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you can opt-out of further e-mail communication from us and will contain an “unsubscribe” link at the bottom of each email.

HOW WE USE YOUR INFORMATION

Use of Information

We engage a third party for processing, storage and transmission of data received through the App back to us. The data we receive from our third party processor includes your email address and completion statistics of resources provided through the App.

However, to the extent we collect and process your data, we do so to serve our own legitimate organizational interests. Generally, the purpose of collecting your information through our App is to:

  • Operate, improve and provide our App and its contents to you;
  • Provide you with information, products or services that you request from us;
  • Collect statistical data and analyze trends for our use, and for use by third-parties to better understand your needs and interests;
  • Improve our Services, marketing and promotional efforts or troubleshoot issues on our App;
  • Allow you to participate in interactive and social features on our App;
  • Improve the content, functionality and usability of this App and provide a tailored and personalized experience for you when you visit our App;
  • Prevent fraudulent activities and security breaches;
  • For any other purpose with your consent.

Disclosure of your Information

We may disclose your personal information that we collect, or you provide as described in this Privacy Policy with third parties in certain circumstances. We may share your data with third party processors as needed to serve our legitimate organizational interests. We will not sell your information to any third-party. We may share your Information with third parties from time to time in certain situations and in order to carry out the following organizational operations:

  • Administering our App and various tasks such as payment processing, hosting services, email delivery, communications and customer service;
  • Delivery of our Services;
  • Administering your account;
  • Entering into agreements and communication with you;
  • Analyzing data and trends, including partnering with third-party analytic companies;
  • Protecting the security of our organization and the App; including to investigate and remedy any breach of any of our rights or policies, or as needed to obtain and maintain insurance coverage, manage risks, obtain financial or legal advice;
  • Promoting and marketing the App and Services;
  • To comply with any requirements to disclose by law, such as to initiate or respond to any legal action or to protect the rights, property and safety of others. This includes sharing information with other parties to prevent security breaches, fraud or credit risks;
  • Any other reason necessary to comply with any legal obligation, to protect your interests, the interests of others or our organization;
  • With your consent.

We also may disclose aggregated information about our users and information that does not identify any individual in compliance with this Privacy Policy and without restriction.

Retention of Information

We retain your information only as long as is reasonably necessary to provide you with the Services, comply with our legal obligations or until you request that we delete your information. Any information we no longer need will be permanently deleted.

International Data

Your information, including Personal Data, may be transferred to and maintained on servers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place.

Processing Your Information

Generally, we do not process or hold your Information but instead we use third-party processors to process your data. In some instances, however, we may process your information internally. When you agree to be bound by our Privacy Policy, you consent to our processing of your information for such purposes to carry out our organizational interests.

Protection of Your Information
We employ commercially reasonable methods to ensure the security of the information you voluntarily provide to us, as well as that information that is collected automatically. We implement a variety of security measures to maintain the safety of your personal information including using standard security protocols. Since email is not considered secure, please do not send us private information via email. Doing so is completely at your own risk. In order to protect our App, we use software programs to monitor network traffic to identify unauthorized attempts to upload or change information or hack or otherwise damage our App.  While we take these steps to protect your personal information as much as we can, no system or transmission of data over the internet or any other public network or any storage of data can be guaranteed to be 100% secure. Event of a Breach

In the unlikely event customer data has been lost, stolen, or potentially compromised, our policy is to alert our customers via email no later than 72 hours of our becoming aware of the event. We will also report such incident to any required data protection authority. We will work closely with any customers affected to determine next steps such as any end-user notifications, needed patches, and how to avoid any similar event in the future.

YOUR RIGHTS

We respect your rights to your personal information and data. You have the right to access, correct, request restriction or deletion of your information, or request how we use your personal information and data collected, as required by applicable law. Note that we may charge a reasonable fee for actions that you ask us to take with respect to your data. In addition, we reserve the right to first request you provide us with evidence verifying your identity before we take any action.

  • Update or change any information you have provided to us. To update or delete your information, please contact us at hello@checkingin.co
  • Request that we confirm what data we hold about you, and for what purposes. You also have the right to confirmation of whether we process your data or deliver your data to third party processors, and for what purposes. We will supply you with copies of your personal data unless doing so would affect the rights and freedoms of others;
  • Change your consent to our use of your information. In such cases, we may require you to delete your account with us, as described above, and you may not have full access to our App;
  • Request a digital copy of the data that we hold about you. Your first request for a copy of your personal data will be provided free of charge; subsequent requests will incur a reasonable fee.
  • Request that we delete all data that we hold about you, and we must delete such data without undue delay. There are exceptions to this right, such as when keeping your data is required by law, is necessary to exercise the right of freedom of expression and information, is required for compliance with a legal obligation, or is necessary for the exercise or defense of legal claims. Such a request may result in a termination of your account with us, and you may have limited or no use of our website;
  • Opt-out of receiving future email correspondence from us by checking the appropriate box when you register for the account or make a purchase. You may change your communication settings by contacting us at hello@checkingin.co
  • Complain to a supervising authority in your jurisdiction if you believe we are misusing your data or have violated any of your rights under this Privacy Policy or applicable law.

If you wish to have any third-parties, including those to whom we’ve transmitted your information, delete your information, you will need to contact those third-parties directly to do so. Upon request, we will provide a list of all third parties to whom we have transmitted your information.

By continuing to use our App, you waive specific notice of, and accept all changes to our Privacy Policy made from time to time. In this policy, we explain what Personal Information we collect from you, as a user of the App, and how we use and manage it. This policy is intended to establish responsible and transparent practices for the management of Personal Information and to satisfy the relevant and applicable legal requirements. This policy sets out the standards, responsibilities and obligations of CheckingIn in respect of any Personal Information collected, accessed or processed by CheckingIn in the course of its business operations.

Please note that when you visit our websites, use our App, sign up for, participate in or purchase a specific product, service, program, contest, promotion or event available through CheckingIn, additional terms and conditions may be provided regarding the collection, use or sharing of Personal Information in connection with that product, service, program, contest, promotion or event. We will obtain consent when we want to use Personal Information for a new purpose or for a purpose other than those stated at the time of collection, in this policy or in the terms and conditions of a specific product, service, program, contest, promotion or event you signed up for, participated in or purchased.

Consent can be “express” through words or by specific acts or “implied” by the conduct of the individual whose Personal Information is being collected, used or shared. Unless we determine that we require an additional consent for specific products, services, programs, contests, promotions or events, you agree and consent that as a provider of Personal Information, we may collect, use, share or otherwise process your Personal Information in accordance with this policy.

You may withdraw your consent for certain purposes. For example, you may choose not to receive:

  • information addressed to you personally about products, services, programs, contests, promotions or events offered by CheckingIn, affiliated companies or companies with whom we have business relationships; or
  • invitations addressed to you personally to comment on the products, services, programs, contests, promotions or events that you use or that are available to you.

If you choose not to provide us with certain Personal Information or if you withdraw your consent, where such withdrawal is available, we may not be able to offer you the products, services, programs, contests, promotions, events or information that you requested or that could be offered to you.

Please also be aware that, even if you have withdrawn your consent to receive marketing communications from us, we may continue to contact you for certain non-marketing purposes necessary for the management of our businesses, as required by law or related to products, services, programs, contests, promotions or events that you had signed up for, agreed to participate in or purchased.

To withdraw or limit your consent, you can contact us as described below. If you have a product, service or program, such as a credit card, or are participating in a contest, promotion or event, that is offered by a third party together with CheckingIn, you may also have to provide your consent preferences or withdraw your consent with that third party separately.

Please note that it may take some time for all of our records to reflect changes in your preferences. For example, if you request that you not receive personalized marketing communications from CheckingIn, your preference may not be captured for a promotion already in progress.

5. How We Collect Personal Information

CheckingIn collects Personal Information in a variety of ways such as when you set up an account, your use of our App, during the course of your purchase of, or application for our products and services or your participation in one or more of our programs, contests, promotions or events. CheckingIn limits the collection of Personal Information to what is reasonably required.

CheckingIn collects Personal Information in the following ways:

  1. Directly from you: You may provide Personal Information to us in person, through our App or websites or in any other direct manner.
  2. Through a Client: A Client of CheckingIn may provide Personal information to us through that group or organization.
  3. Through technology: We may collect Personal Information and non-personal information through various technologies directly from you or your group or organization. For instance, we may access Personal Information about you when you interact with us electronically such as through our information technology systems, websites, email, social media properties or online advertising. For example, when you visit one of our social media sites, we may collect Personal Information that you choose to submit to us such as your name, contact information, opinions or any other information you choose to provide for the purposes of responding to an enquiry you have made, or for any other purpose disclosed to you at the time of the collection.

When you interact with us, such as when you use our App, visit our websites or click on our ads, we may use, and send to your device or computer, cookies, web beacons, single-pixel gifs and other technologies to help us collect and store Personal Information or non-personal information about you or to enable us to present offers to you, including interest-based ads. These technologies are used to help us understand what actions you take on our own and on third parties’ websites. For instance, we may store Personal Information and non-personal information, such as your name, email address, location and language preference, on one of these technologies to enable us to populate entry fields that you have previously completed or present you with content specific to your region and language preference.

We may also record user and usage data, such as the type of device you are using, where users click on a page, the internet protocol (“IP”) address, operating system, which website or ad the user clicked on to reach our website and which search terms were used, to help us optimize our websites, generate reports, display interest-based advertisements, or understand which key words result in visits to our websites.

You may delete or disable certain of these technologies, such as cookies, at any time via your browser. However, if you do so, you may not be able to use some of the features of our websites.

If you choose to download or use our App, we may receive Personal Information and non-personal information such as a unique identifier for your device. Most devices, tablets and browsers allow you to turn off the tracking of your location. However, if you do so, you may not be able to use some or all of the functionality of our App, including location-based features such as weather.

We may use third parties and their tools, such as Google Firebase, an App analytics service of Google Inc. (“Google”) to analyze your use of our App as well as other services to provide us with analytics on our websites, and these analyses will create non-personally identifiable reports about visitor activities for us and to provide further services associated with the use of our App, web sites and the Internet.

6. How We Use Personal Information – Purposes

We identify the purpose for which Personal Information will be used typically at or before the time the Personal Information is collected. Our use of Personal Information is limited to the purposes described in this policy, the purposes set out in the terms and conditions of any product, service, program, contest, promotion or event in connection with which Personal Information was collected, purposes required by law and purposes consistent with any of those purposes. As new purposes may develop over time, we may update this policy, so we encourage, you to review this policy periodically online.

CheckingIn collects, uses and shares Personal Information for the following purposes, which involve, among other things, the activities described for each:

A. Provision of Products, Services, Programs, Contests, Promotions or Events

To provide products, services, programs, contests, promotions or events, which includes:

  • Creating, administering, and maintaining accounts, which may include processing your application or verifying your identity, determining your eligibility for a product, service or program, or protecting parties from errors and fraud; and
  • Processing your transactions or contacting you about special offers;

In the event you are a part of a group or organization that is a Client of CheckingIn, we may use or and share certain data you provide through your use of our App to our Client in an anonymized fashion. No information regarding your usage of our App will ever be shared on an individual or personalized level. This anonymized usage data will not be considered Personal Information for the purposes of this policy.

B. Business Management

In order to manage our businesses, which includes:

  • Maintaining the security of the public and customers, employees and property;
  • Maintaining quality service levels and to assist in training staff and service providers;
  • Deploying and managing our information technology applications and systems, including to troubleshoot a problem or to test systems including before a change is deployed throughout a system (we use non-personal or anonymized information for such purposes as much as possible); and
  • Managing and facilitating the use of our websites and mobile applications, which may include using cookies and other similar technology.

We use third-party use cookies, web beacons and other site-related technologies for various purposes including session management, traffic monitoring, personalization, transactions (e.g. credit card sales), marketing or promotional purposes, to better understand which web, mobile or other electronic features you use, or to improve or to develop new products, services, programs, contests, promotions or events. For example, we may use cookies to count the number of visitors to our websites, and to compile aggregated information on websites and user activity to help us improve the functionality of our websites.

C. Communication

In order to communicate with you, which includes:

  • Informing you about special offers and promotions or products, services, programs or events that CheckingIn reasonably believes may be of interest to you;
  • Enabling your participation in contests, promotions, surveys, chats, seminars or workshops, including contests where entry is automatic;
  • Responding to your enquiries;
  • Providing you with information about the App, services, programs, promotions, contests and events you currently have or are participating in;
  • Recommending products, services, programs, promotions, contests or events to meet your needs;
  • Providing you with offers or services based on the location provided by your mobile device (also referred to as location-based advertising) or based on your interests;
  • Establishing a record of the Personal Information you provide or that we receive about you; and
  • Communicating changes to CheckingIn’s policies or procedures that affect you, including this policy.

Unless you tell us otherwise or consent is required by law, we may contact you by any means for which you have provided contact information.

9. How We Share Personal Information

We may share Personal Information about you with other organizations outside of CheckingIn that help CheckingIn provide products, services, programs, promotions, contests or events or help us with our business operations. These other organizations may include sub-contractors, third party service providers, third parties that offer products, services, programs, promotions, contests or events under one of our brands, or organizations that help us improve our products, services, programs, promotions, contests or events as well as our business and technology systems, procedures and infrastructure. When CheckingIn shares Personal Information with any such party, we limit the use of such Personal Information to those purposes requested by us and we require the party to have appropriate safeguards for the protection of that Personal Information.

In the event you are a part of a group or organization that is a Client of CheckingIn, we may use or and share data you provide through your usage of our App to our Client in an anonymized fashion. All such data is anonymized and no such information regarding your usage of our App will ever be shared on an individual or personalized level. As such, anonymized usage data will not be considered Personal Information for the purposes of this policy.

10. Other Sharing

Canadian law permits or requires the use or sharing of Personal Information without consent in specific circumstances. These circumstances include situations when permitted or required by law or when necessary to protect CheckingIn, employees, customers, or others. Should this occur, CheckingIn will not share more Personal Information than is required to fulfill that purpose.

CheckingIn complies with this policy as well as applicable Canadian private sector data protection laws such as the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and substantially similar provincial laws pertaining to the collection, use and disclosure of Personal Information.

11. Sale Or Transfer Of Business 

From time to time, we may decide to sell or transfer all or part of our business to a related company or to a third party, to merge with another entity, to insure or securitize its assets, or to engage in another form of corporate or financing transaction (including transfers made as part of insolvency or bankruptcy proceedings or as part of a corporate reorganization or stock sale or other change in corporate control). In addition, the way products, services, programs, contests, promotions and events are provided to you, and the organization providing those products, services, programs, contests, promotions or events, may also change.

If your Personal Information is required in connection with any such transaction, unless otherwise agreed to in a contractual arrangement between a User and CheckingIn, your Personal Information may be transferred by CheckingIn to the buyer. CheckingIn will require that the parties involved in any such transaction, including affiliates, advisors or other service providers, agree to protect your Personal Information with policies meeting standards equivalent to those set out in this policy both during and after completion of the transaction.

Similarly, the relationship between CheckingIn and a third party that provides a product, service, program, contest, promotion or event under a CheckingIn brand may cease. If that third party continues to provide a product, service, program, contest, promotion or event to you, your Personal Information will be subject to that third party’s privacy policy.

Other than as stated in this policy or as stated in terms and conditions CheckingIn has with a Client, or as part of a consent in relation to a product, service, program, contest, promotion or event, CheckingIn does not share any Personal Information with third parties.

12. How We Protect Personal Information

13. Storage Use and Disposal of Personal Information

How Long We Keep Personal Information

We actively retain Personal Information only as long as it is required for our relationship and a certain period of time afterwards to respond to queries or as required by federal and provincial laws. When this period ends, Personal Information is scheduled for destruction according to our record retention policies. Depending on the nature of the Personal Information and the purpose for which it was collected, this schedule may vary.

Where We Keep, Use Personal Information

In general, we store, access and use Personal Information in Canada. However, Personal Information may also be stored, accessed, or used outside of Canada. For instance, when we engage a service provider outside of Canada, Personal Information may be stored, accessed or used in any country where the service provider is located, or from which it provides services, including the United States.

14. Access and Dispute Resolution

CheckingIn provides a right of access and review of your Personal Information in accordance with applicable laws and will endeavor to provide the Personal Information in question within a reasonable time. You will be asked for identification so that we may verify your identity before providing you with your Personal Information. If you require the documents in an alternative format, we will make reasonable efforts to provide you with your Personal Information in that format. If there will be charges for us to retrieve or provide you with specific information that you have requested, we will advise you of the charges that you would be responsible for and obtain your authorization before proceeding.

Our policy is to respond to access requests as required by applicable laws. CheckingIn may decline access to Personal Information in certain circumstances. These include where the information requested would reveal confidential information or Personal Information about someone else, or if legal or regulatory requirements prohibit providing access or permit not providing access to such information.

CheckingIn encourages you to review this policy periodically. If you have a product, service, program, or are participating in a promotion, contest or event that is offered by a third party under a CheckingIn brand, the third party may hold certain of your Personal Information. Should you have any questions or concerns, we will direct you to the appropriate contact so that you may make enquiries as to that party’s privacy policies and practices.

At CheckingIn, we understand the responsibility that comes along with collecting, using and sharing Personal Information. TA SKWÁLWENTN – SQUAMISH NATION PRIVACY POLICY

Squamish Nation (“we”, “our” or “us”) respects your privacy and is committed to protecting it. This Privacy Policy applies to your access to the ta skwálwentn application and any related mobile applications, including any content, functionality or services offered through the application or related online offerings (collectively, the “App”) whether as a guest or a registered user.  

This Privacy Policy is legally binding. By using our App or agreeing to the Terms of Use for the App, you expressly accept and agree to be bound by this Privacy Policy. If you do not agree to this Privacy Policy, you must not access or use our App or Services.

This Privacy Policy sets out how we collect information from you when you visit our App, either automatically, or through certain voluntary actions you may take while visiting our App, including but not limited to, accessing or downloading any content or resources available on our App or engaging or interacting with the App (collectively, “Services”).

This Privacy Policy also sets out how we use and disclosure your information and your rights with respect to any Personal Information that we collect. This Privacy Policy is intended to establish responsible and transparent practices for the management of Personal Information and to satisfy the relevant and applicable legal requirements.

This Privacy Policy applies to information we collect:

  • On or through the App;
  • In email, text and other electronic messages between you and the App;
  • When you interact with us on third party applications or websites if those applications or websites include links to this Privacy Policy.

This Privacy Policy does not apply to information collected by:

  • Us offline or through any other means, including on any other application or website operated by us, or any third party including our partners, affiliates and subsidiaries;
  • Any third party involved in the creation, hosting, development or infrastructure support for the App, including for greater certainty CheckingIn Software Ltd. (“CheckingIn”), as those parties will have their own privacy policy which will apply to any such collection.  CheckingIn’s Privacy Policy can be found BELOW.

Please note: we may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by in-App message, email (sent to the e-mail address specified in your account) or by means of a notice in the App prior to the change becoming effective. INFORMATION WE COLLECT

We collect certain types of information from you when you visit our App. By accepting this Privacy Policy, you are expressly consenting to (i) our collection of information as described below; (ii) our use of the information collected; (iii) the processing of this information; and (iv) our sharing of data with third-party processors as needed to run our organization.


Here are some examples of the data we collect. Please note that this may not be a complete list:

Personal Information: Personal identifying information such as your name, billing and/or shipping address, telephone numbers, email addresses, and other demographic information, such as your age and gender.

User Account Information: In order to access certain Services, we may require you to create a user account and provide your name and/or email address and create a unique password. For your security, we do not have access or knowledge of your password and it is your sole responsibility to keep the password confidential and not share your account details with any other people, including us.

Sensitive Information

We will not request sensitive information from you at any time. Please do not submit any sensitive data to us, including your social insurance or security number, health data, genetic data, or information related to your ethnic origin, religious beliefs, or criminal history. If you do send us this information, then by doing so you are consenting to our use, storage, and processing of this information in accordance with this Policy.

What Personal Information is Not

This policy does not cover non-personal information, which is information that does not identify you. However, in the event that we link any non-personal information to an identifiable individual, then that information will become personal information and become subject to this policy. For greater certainty, personal information that is aggregated and/or anonymized or that cannot be associated with an identifiable individual is not personal information.

HOW WE COLLECT YOUR INFORMATION

Information You Voluntarily Provide

We collect information you voluntarily and manually provide when you use our App, such as when you access Services or certain content on our App, sign up for our email list or newsletter, submit a form, send us questions, or interact with us through this App such as when you provide comments or feedback. Some of the information you manually provide may be personal information, such as your name or email address.

Third-Party Use of Cookies and Other Tracking Technologies 
Some content or applications, are served by third-parties, including advertisers, ad networks and/or servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

App Analytics

From time to time, we may use third party analytic tools operated by third-party companies. These analytic tools may also use cookies or other tracking technologies to analyze visitors’ use of our App to determine the popularity of the content, and better understand online activity. We do not transfer personal information to these third party vendors. However, in order to access our App, you are consenting to the collection and use of your information by these third party analytic companies. We recommend you  review their respective privacy policies and contact them directly with any questions or requests to delete your information.

Email Policies

We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as expressly set out in this Privacy Policy. In compliance with Canada’s anti-spam legislation all e-mails sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you can opt-out of further e-mail communication from us and will contain an “unsubscribe” link at the bottom of each email.

HOW WE USE YOUR INFORMATION

Use of Information

We engage a third party for processing, storage and transmission of data received through the App back to us. The data we receive from our third party processor includes your email address and completion statistics of resources provided through the App.

However, to the extent we collect and process your data, we do so to serve our own legitimate organizational interests. Generally, the purpose of collecting your information through our App is to:

  • Operate, improve and provide our App and its contents to you;
  • Provide you with information, products or services that you request from us;
  • Collect statistical data and analyze trends for our use, and for use by third-parties to better understand your needs and interests;
  • Improve our Services, marketing and promotional efforts or troubleshoot issues on our App;
  • Allow you to participate in interactive and social features on our App;
  • Improve the content, functionality and usability of this App and provide a tailored and personalized experience for you when you visit our App;
  • Prevent fraudulent activities and security breaches;
  • For any other purpose with your consent.

Disclosure of your Information

We may disclose your personal information that we collect, or you provide as described in this Privacy Policy with third parties in certain circumstances. We may share your data with third party processors as needed to serve our legitimate organizational interests. We will not sell your information to any third-party. We may share your Information with third parties from time to time in certain situations and in order to carry out the following organizational operations:

  • Administering our App and various tasks such as payment processing, hosting services, email delivery, communications and customer service;
  • Delivery of our Services;
  • Administering your account;
  • Entering into agreements and communication with you;

  • Protecting the security of our organization and the App; including to investigate and remedy any breach of any of our rights or policies, or as needed to obtain and maintain insurance coverage, manage risks, obtain financial or legal advice;
  • Promoting and marketing the App and Services;
  • To comply with any requirements to disclose by law, such as to initiate or respond to any legal action or to protect the rights, property and safety of others. This includes sharing information with other parties to prevent security breaches, fraud or credit risks;
  • Any other reason necessary to comply with any legal obligation, to protect your interests, the interests of others or our organization;
  • With your consent.

We also may disclose aggregated information about our users and information that does not identify any individual in compliance with this Privacy Policy and without restriction.

Retention of Information

We retain your information only as long as is reasonably necessary to provide you with the Services, comply with our legal obligations or until you request that we delete your information. Any information we no longer need will be permanently deleted.

International Data

Your information, including Personal Data, may be transferred to and maintained on servers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place.

Processing Your Information

Generally, we do not process or hold your Information but instead we use third-party processors to process your data. In some instances, however, we may process your information internally. When you agree to be bound by our Privacy Policy, you consent to our processing of your information for such purposes to carry out our organizational interests.

Protection of Your Information
We employ commercially reasonable methods to ensure the security of the information you voluntarily provide to us, as well as that information that is collected automatically. We implement a variety of security measures to maintain the safety of your personal information including using standard security protocols. Since email is not considered secure, please do not send us private information via email. Doing so is completely at your own risk. In order to protect our App, we use software programs to monitor network traffic to identify unauthorized attempts to upload or change information or hack or otherwise damage our App.  While we take these steps to protect your personal information as much as we can, no system or transmission of data over the internet or any other public network or any storage of data can be guaranteed to be 100% secure. Event of a Breach

In the unlikely event customer data has been lost, stolen, or potentially compromised, our policy is to alert our customers via email no later than 72 hours of our becoming aware of the event. We will also report such incident to any required data protection authority. We will work closely with any customers affected to determine next steps such as any end-user notifications, needed patches, and how to avoid any similar event in the future.

YOUR RIGHTS

We respect your rights to your personal information and data. You have the right to access, correct, request restriction or deletion of your information, or request how we use your personal information and data collected, as required by applicable law. Note that we may charge a reasonable fee for actions that you ask us to take with respect to your data. In addition, we reserve the right to first request you provide us with evidence verifying your identity before we take any action.

  • Request that we confirm what data we hold about you, and for what purposes. You also have the right to confirmation of whether we process your data or deliver your data to third party processors, and for what purposes. We will supply you with copies of your personal data unless doing so would affect the rights and freedoms of others;
  • Change your consent to our use of your information. In such cases, we may require you to delete your account with us, as described above, and you may not have full access to our App;
  • Request a digital copy of the data that we hold about you. Your first request for a copy of your personal data will be provided free of charge; subsequent requests will incur a reasonable fee.
  • Request that we delete all data that we hold about you, and we must delete such data without undue delay. There are exceptions to this right, such as when keeping your data is required by law, is necessary to exercise the right of freedom of expression and information, is required for compliance with a legal obligation, or is necessary for the exercise or defense of legal claims. Such a request may result in a termination of your account with us, and you may have limited or no use of our website;
  • Opt-out of receiving future email correspondence from us by checking the appropriate box when you register for the account or make a purchase. You may change your communication settings by contacting us at hello@taswkalwentn.com
  • Complain to a supervising authority in your jurisdiction if you believe we are misusing your data or have violated any of your rights under this Privacy Policy or applicable law.

Consent can be “express” through words or by specific acts or “implied” by the conduct of the individual whose Personal Information is being collected, used or shared. Unless we determine that we require an additional consent for specific products, services, programs, contests, promotions or events, you agree and consent that as a provider of Personal Information, we may collect, use, share or otherwise process your Personal Information in accordance with this policy.

You may withdraw your consent for certain purposes. For example, you may choose not to receive:

  • information addressed to you personally about products, services, programs, contests, promotions or events offered by CheckingIn, affiliated companies or companies with whom we have business relationships; or
  • invitations addressed to you personally to comment on the products, services, programs, contests, promotions or events that you use or that are available to you.

If you choose not to provide us with certain Personal Information or if you withdraw your consent, where such withdrawal is available, we may not be able to offer you the products, services, programs, contests, promotions, events or information that you requested or that could be offered to you.

Please also be aware that, even if you have withdrawn your consent to receive marketing communications from us, we may continue to contact you for certain non-marketing purposes necessary for the management of our businesses, as required by law or related to products, services, programs, contests, promotions or events that you had signed up for, agreed to participate in or purchased.

To withdraw or limit your consent, you can contact us as described below. If you have a product, service or program, such as a credit card, or are participating in a contest, promotion or event, that is offered by a third party together with CheckingIn, you may also have to provide your consent preferences or withdraw your consent with that third party separately.

Please note that it may take some time for all of our records to reflect changes in your preferences. For example, if you request that you not receive personalized marketing communications from CheckingIn, your preference may not be captured for a promotion already in progress.

5. How We Collect Personal Information

CheckingIn collects Personal Information in a variety of ways such as when you set up an account, your use of our App, during the course of your purchase of, or application for our products and services or your participation in one or more of our programs, contests, promotions or events. CheckingIn limits the collection of Personal Information to what is reasonably required.

CheckingIn collects Personal Information in the following ways:

  1. Directly from you: You may provide Personal Information to us in person, through our App or websites or in any other direct manner.
  2. Through a Client: A Client of CheckingIn may provide Personal information to us through that group or organization.
  3. Through technology: We may collect Personal Information and non-personal information through various technologies directly from you or your group or organization. For instance, we may access Personal Information about you when you interact with us electronically such as through our information technology systems, websites, email, social media properties or online advertising. For example, when you visit one of our social media sites, we may collect Personal Information that you choose to submit to us such as your name, contact information, opinions or any other information you choose to provide for the purposes of responding to an enquiry you have made, or for any other purpose disclosed to you at the time of the collection.

When you interact with us, such as when you use our App, visit our websites or click on our ads, we may use, and send to your device or computer, cookies, web beacons, single-pixel gifs and other technologies to help us collect and store Personal Information or non-personal information about you or to enable us to present offers to you, including interest-based ads. These technologies are used to help us understand what actions you take on our own and on third parties’ websites. For instance, we may store Personal Information and non-personal information, such as your name, email address, location and language preference, on one of these technologies to enable us to populate entry fields that you have previously completed or present you with content specific to your region and language preference.

We may also record user and usage data, such as the type of device you are using, where users click on a page, the internet protocol (“IP”) address, operating system, which website or ad the user clicked on to reach our website and which search terms were used, to help us optimize our websites, generate reports, display interest-based advertisements, or understand which key words result in visits to our websites.

You may delete or disable certain of these technologies, such as cookies, at any time via your browser. However, if you do so, you may not be able to use some of the features of our websites.

If you choose to download or use our App, we may receive Personal Information and non-personal information such as a unique identifier for your device. Most devices, tablets and browsers allow you to turn off the tracking of your location. However, if you do so, you may not be able to use some or all of the functionality of our App, including location-based features such as weather.

We may use third parties and their tools, such as Google Firebase, an App analytics service of Google Inc. (“Google”) to analyze your use of our App as well as other services to provide us with analytics on our websites, and these analyses will create non-personally identifiable reports about visitor activities for us and to provide further services associated with the use of our App, web sites and the Internet.

6. How We Use Personal Information – Purposes

We identify the purpose for which Personal Information will be used typically at or before the time the Personal Information is collected. Our use of Personal Information is limited to the purposes described in this policy, the purposes set out in the terms and conditions of any product, service, program, contest, promotion or event in connection with which Personal Information was collected, purposes required by law and purposes consistent with any of those purposes. As new purposes may develop over time, we may update this policy, so we encourage, you to review this policy periodically online.

CheckingIn collects, uses and shares Personal Information for the following purposes, which involve, among other things, the activities described for each:

A. Provision of Products, Services, Programs, Contests, Promotions or Events

To provide products, services, programs, contests, promotions or events, which includes:

  • Creating, administering, and maintaining accounts, which may include processing your application or verifying your identity, determining your eligibility for a product, service or program, or protecting parties from errors and fraud; and
  • Processing your transactions or contacting you about special offers;

In the event you are a part of a group or organization that is a Client of CheckingIn, we may use or and share certain data you provide through your use of our App to our Client in an anonymized fashion. No information regarding your usage of our App will ever be shared on an individual or personalized level. This anonymized usage data will not be considered Personal Information for the purposes of this policy.

B. Business Management

In order to manage our businesses, which includes:

  • Maintaining the security of the public and customers, employees and property;
  • Maintaining quality service levels and to assist in training staff and service providers;
  • Deploying and managing our information technology applications and systems, including to troubleshoot a problem or to test systems including before a change is deployed throughout a system (we use non-personal or anonymized information for such purposes as much as possible); and
  • Managing and facilitating the use of our websites and mobile applications, which may include using cookies and other similar technology.

We use third-party use cookies, web beacons and other site-related technologies for various purposes including session management, traffic monitoring, personalization, transactions (e.g. credit card sales), marketing or promotional purposes, to better understand which web, mobile or other electronic features you use, or to improve or to develop new products, services, programs, contests, promotions or events. For example, we may use cookies to count the number of visitors to our websites, and to compile aggregated information on websites and user activity to help us improve the functionality of our websites.

C. Communication

In order to communicate with you, which includes:

  • Informing you about special offers and promotions or products, services, programs or events that CheckingIn reasonably believes may be of interest to you;
  • Enabling your participation in contests, promotions, surveys, chats, seminars or workshops, including contests where entry is automatic;
  • Responding to your enquiries;
  • Providing you with information about the App, services, programs, promotions, contests and events you currently have or are participating in;
  • Recommending products, services, programs, promotions, contests or events to meet your needs;
  • Providing you with offers or services based on the location provided by your mobile device (also referred to as location-based advertising) or based on your interests;
  • Establishing a record of the Personal Information you provide or that we receive about you; and
  • Communicating changes to CheckingIn’s policies or procedures that affect you, including this policy.

Unless you tell us otherwise or consent is required by law, we may contact you by any means for which you have provided contact information.

9. How We Share Personal Information

We may share Personal Information about you with other organizations outside of CheckingIn that help CheckingIn provide products, services, programs, promotions, contests or events or help us with our business operations. These other organizations may include sub-contractors, third party service providers, third parties that offer products, services, programs, promotions, contests or events under one of our brands, or organizations that help us improve our products, services, programs, promotions, contests or events as well as our business and technology systems, procedures and infrastructure. When CheckingIn shares Personal Information with any such party, we limit the use of such Personal Information to those purposes requested by us and we require the party to have appropriate safeguards for the protection of that Personal Information.

In the event you are a part of a group or organization that is a Client of CheckingIn, we may use or and share data you provide through your usage of our App to our Client in an anonymized fashion. All such data is anonymized and no such information regarding your usage of our App will ever be shared on an individual or personalized level. As such, anonymized usage data will not be considered Personal Information for the purposes of this policy.

10. Other Sharing

Canadian law permits or requires the use or sharing of Personal Information without consent in specific circumstances. These circumstances include situations when permitted or required by law or when necessary to protect CheckingIn, employees, customers, or others. Should this occur, CheckingIn will not share more Personal Information than is required to fulfill that purpose.

CheckingIn complies with this policy as well as applicable Canadian private sector data protection laws such as the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and substantially similar provincial laws pertaining to the collection, use and disclosure of Personal Information.

11. Sale Or Transfer Of Business 

From time to time, we may decide to sell or transfer all or part of our business to a related company or to a third party, to merge with another entity, to insure or securitize its assets, or to engage in another form of corporate or financing transaction (including transfers made as part of insolvency or bankruptcy proceedings or as part of a corporate reorganization or stock sale or other change in corporate control). In addition, the way products, services, programs, contests, promotions and events are provided to you, and the organization providing those products, services, programs, contests, promotions or events, may also change.

If your Personal Information is required in connection with any such transaction, unless otherwise agreed to in a contractual arrangement between a User and CheckingIn, your Personal Information may be transferred by CheckingIn to the buyer. CheckingIn will require that the parties involved in any such transaction, including affiliates, advisors or other service providers, agree to protect your Personal Information with policies meeting standards equivalent to those set out in this policy both during and after completion of the transaction.

Similarly, the relationship between CheckingIn and a third party that provides a product, service, program, contest, promotion or event under a CheckingIn brand may cease. If that third party continues to provide a product, service, program, contest, promotion or event to you, your Personal Information will be subject to that third party’s privacy policy.

Other than as stated in this policy or as stated in terms and conditions CheckingIn has with a Client, or as part of a consent in relation to a product, service, program, contest, promotion or event, CheckingIn does not share any Personal Information with third parties.

12. How We Protect Personal Information

We employ commercially reasonable methods to ensure the security of the information you voluntarily provide to us, as well as that information that is collected automatically. We implement a variety of security measures to maintain the safety of your personal information including using standard security protocols. Since email is not considered secure, please do not send us private information via email. Doing so is completely at your own risk. In order to protect our App, we use software programs to monitor network traffic to identify unauthorized attempts to upload or change information or hack or otherwise damage our App.  While we take these steps to protect your personal information as much as we can, no system or transmission of data over the internet or any other public network or any storage of data can be guaranteed to be 100% secure. 13. Storage Use and Disposal of Personal Information

How Long We Keep Personal Information

We actively retain Personal Information only as long as it is required for our relationship and a certain period of time afterwards to respond to queries or as required by federal and provincial laws. When this period ends, Personal Information is scheduled for destruction according to our record retention policies. Depending on the nature of the Personal Information and the purpose for which it was collected, this schedule may vary.

Where We Keep, Use Personal Information

In general, we store, access and use Personal Information in Canada. However, Personal Information may also be stored, accessed, or used outside of Canada. For instance, when we engage a service provider outside of Canada, Personal Information may be stored, accessed or used in any country where the service provider is located, or from which it provides services, including the United States.

14. Access and Dispute Resolution

CheckingIn provides a right of access and review of your Personal Information in accordance with applicable laws and will endeavor to provide the Personal Information in question within a reasonable time. You will be asked for identification so that we may verify your identity before providing you with your Personal Information. If you require the documents in an alternative format, we will make reasonable efforts to provide you with your Personal Information in that format. If there will be charges for us to retrieve or provide you with specific information that you have requested, we will advise you of the charges that you would be responsible for and obtain your authorization before proceeding.

Our policy is to respond to access requests as required by applicable laws. CheckingIn may decline access to Personal Information in certain circumstances. These include where the information requested would reveal confidential information or Personal Information about someone else, or if legal or regulatory requirements prohibit providing access or permit not providing access to such information.
